CFA JUDGEMENT ON THE RIGHT OF ABODE OF HONG KONG RESIDENTS
The Bar is concerned with the various comments as a result of the recent
Court of Final Appeal Judgement on the right of abode of Hong Kong residents.
The Bar is deeply conscious of the immediate impact of the Judgment on
the social resources of Hong Kong. However, one must not lose sight of
the immense importance of the Judgment for the confirmation and preservation
of the Rule of Law and Judicial independence in Hong Kong and the affirmation
of Hong Kong's high degree of autonomy under the Basic Law. We would respectfully
urge the Government in tackling the present problems, to also give its
unqualified support and commitment to the Court of Final Appeal Judgment.
In the respect, the Government should not just accept but also be seen
to fully embrace and respect the final ruling of our highest Court. The
Rule of Law in Hong Kong should never be compromised by what may probably
be mere near-term practical but nonetheless onerous difficulties.
